These terms apply to every order placed with AirForce Suspension UK through airforce-sus.co.uk, by email or by phone. Please read them before you order. By placing an order you agree to them.
1. Who you are buying from
AirForce Suspension UK is a trading name of INPUT IT LTD, company number 04812979, VAT number VAT registration number available on request, registered office Input IT Ltd, Unit 10/6 Pickup Storage, Grangefield Road, Pudsey, LS28 6JR, United Kingdom. Contact: [email protected].
"You" means the customer. If you buy for purposes outside your trade or business you are a consumer and have the statutory rights described in these terms. If you buy as a business, sections 9 and 12 apply differently, as noted.
2. Ordering and the contract
When you place an order we send an acknowledgement. That is not acceptance. The contract is formed when we send you an order confirmation stating that the goods are in production or dispatched. We may decline an order, for example if the kit is not available for your vehicle, a price was listed in error, or we cannot deliver to your address. If we decline, we refund any payment in full.
You are responsible for checking that the vehicle details you give us are correct. Kits are built to those details.
3. Made-to-order kits
Strut and bag kits are built to your vehicle specification by the manufacturer after you order. They are goods made to the consumer’s specifications for the purposes of the Consumer Contracts Regulations 2013, and the 14-day cancellation right does not apply once production has started. We tell you this at checkout and ask you to confirm it.
We quote a lead time before you pay. Lead times are estimates based on the manufacturer’s current schedule. If the estimate changes by more than two weeks after you order, we will tell you and you may cancel for a full refund.
4. Prices and VAT
All prices are in pounds sterling and include UK VAT at the current rate unless stated otherwise. Delivery is charged in addition and shown at checkout before you pay. We may change prices at any time, but a change does not affect an order we have already confirmed.
If a price is obviously wrong and you could reasonably have known it was a mistake, we are not obliged to supply at that price.
5. Payment
Payment is taken in full when you place the order, through Stripe or another method shown at checkout. For made-to-order kits we do not send the order to the manufacturer until payment has cleared. Trade accounts with agreed credit terms pay in accordance with their account agreement.
6. Delivery
We deliver to the UK and the Republic of Ireland as described on the delivery page, which forms part of these terms. Delivery dates are estimates. We are not liable for delay caused by events outside our reasonable control, including manufacturer delays, freight disruption and customs holds, but we will keep you informed and you may cancel an undelivered order that is significantly late.
You must check goods on delivery and report damage or shortages within 48 hours as set out on the delivery page.
7. Risk and title
Risk in the goods passes to you when they are delivered to the address you gave us, or to a carrier you nominated. Ownership passes when we have received payment in full.
8. Cancellation and returns
Your cancellation and return rights are set out on the returns page, which forms part of these terms. In summary: off-the-shelf goods can be returned unused within 14 days of delivery; made-to-order kits cannot be cancelled once production has started; faulty goods are covered by the Consumer Rights Act 2015 whatever their type.
9. Warranty and quality
Goods come with the manufacturer’s warranty described on the warranty page. For consumers, this is in addition to your rights under the Consumer Rights Act 2015, which are not affected by anything in these terms.
For business customers, the manufacturer’s warranty is the only warranty given, and all terms implied by the Sale of Goods Act 1979 or otherwise as to quality or fitness are excluded to the extent the law allows.
10. Fitting and use
Goods must be fitted by a competent person in accordance with the manufacturer’s instructions. You are responsible for ensuring the vehicle remains safe and legal for use on the road, for declaring the modification to your insurer, and for complying with MOT requirements. We give fitment and setup advice in good faith based on the information you give us, but you and your fitter remain responsible for the installation.
11. Intellectual property
The AirForce name and logos belong to the manufacturer. Content on this site belongs to us or our licensors. You may not copy it for commercial use without permission.
12. Liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
Subject to that, we are not liable for loss that was not foreseeable when the contract was made, for loss caused by your failure to follow fitting instructions, or for business losses if you are a consumer. For business customers, our total liability for any order is limited to the price paid for that order, and we are not liable for loss of profit, loss of business or indirect loss.
13. Events outside our control
We are not responsible for failing to perform where that failure is caused by an event outside our reasonable control. If such an event lasts more than 60 days, either of us may cancel the affected order and we will refund any payment for goods not delivered.
14. General
If a court finds part of these terms unenforceable, the rest still applies. These terms are the whole agreement between us for your order. We may update them; the version in force when you order applies to that order.
15. Governing law and disputes
These terms are governed by the law of England and Wales. Disputes will be dealt with by the courts of England and Wales, except that if you live in Scotland or Northern Ireland you may bring proceedings in your local courts. As a consumer you may also use the EU or UK alternative dispute resolution services where available; we are not obliged to take part but will consider it.
16. Complaints
If something has gone wrong, email [email protected] with your order number. We aim to acknowledge within two working days and resolve within 14.
